“Due Process for Public Sector Employees”

This presentation will focus on the procedural and substantive rights of public sector employees in their employment, with an emphasis on managing employee behavior while also avoiding legal claims. Josh will share his perspective as an attorney who defends management disciplinary decisions when challenged in court or before an arbitrator and will explain the kinds of evidence that are helpful (and less than helpful) in this context. Participants will learn best practices when conducting investigations and issuing discipline and should leave with an understanding of the constitutional provisions and Supreme Court rulings at the heart of the due process rights---the “why” of these best practices.
Meet our Speaker:
Joshua Schwartz is a partner at Barley Snyder LLP, a full-service law firm with offices throughout Central Pennsylvania. A prolific trial attorney and counselor, he focuses his practice on employment counseling and litigation, labor law, and workers’ compensation. Josh regularly represents public and private employers in litigation matters, administrative agency investigations, labor arbitration and commercial litigation. He is also a trained and certified mediator and arbitrator.
